The allegations are serious!
Collien Fernandes has reported her ex-husband Christian Ulmen because he is said to have created fake accounts in her name for years. Fake nude photos and AI-generated sex videos of the presenter are said to have been distributed. Because the 44-year-old lives in Mallorca, she went to the police there. In response to a request from RTL, lawyer Kristin Feierg, who is also familiar with Spanish law, explains how the investigations there are now going.

“The process is currently at a very early stage,” said the lawyer. “The complaint contains several allegations, some of them serious, which must now be examined as part of the procedure.” For example, witnesses would be interviewed, communication data evaluated and other evidence examined.

“Whether and to what extent there will actually be an indictment will only be decided as the proceedings continue,” explains Fieberg. The public prosecutor's office must decide based on the evidence whether to discontinue the proceedings or to bring charges. Depending on the case, it could take months for this to happen. “An investigation can take several years,” says the lawyer.
What possible crimes are we talking about?

“Practical experience shows that in such constellations not all accusations made will necessarily stand up in further proceedings. The decisive factor will be which accusations can actually be proven and how the public prosecutor's office classifies them legally,” says Fieberg.

Ulmen's lawyers responded to a request from RTL with an email that cannot be quoted. Questions about the allegations against Ulmen remained unanswered. Christian Ulmen is presumed innocent.

What penalties could Christian Ulmen face in Spain?
Since it is currently unclear whether there will be any charges at all, the lawyer cannot give a concrete forecast as to what punishment Christian Ulmen could threaten in the event of a conviction. That also depends on which allegations can ultimately be proven and are then actually charged.

In Spain, for example, presuming one's identity can be punished with up to three years in prison, says Fieberg. Serious threats even up to five years. However, defendants usually only received fines for insults.

“In practice, there is often a combination of a fine, possibly a prison sentence (often suspended) and protective measures, in particular contact and approach bans,” she explains. “Several years of imprisonment are possible in principle, but require a correspondingly serious and provable overall situation. If there are no previous convictions, this is rather unlikely.”
