As announced immediately after the verdict was announced, the defense lawyers for both defendants appealed against this verdict. “The written reasons for the verdict are not yet available, but that is what matters. Only then will it become clear how the verdict should be legally assessed in detail,” said Alexander Hauer, defense attorney for the 59-year-old landlord. The court has until the end of May to write down the verdict and reasons.
The defense attorneys then have one month to provide written reasons for their appeal. The entire file is then submitted to the Federal Court of Justice (BGH) for review, which decides whether the appeal is admissible or not. It is currently impossible to determine when this decision will be made. If the Federal Court of Justice allows the appeal, the case will be heard again and completely new. Until then, the judgment is not legally binding. (bac)
