It is not always easy to secure the sun loungers at the hotel pool while on holiday; they are often reserved with towels. A traveler doesn't want to put up with that and demands his money back – with success!
Despite hotel rules: sun loungers reserved from 6:00 a.m
Most people are probably familiar with it: you're finally on vacation, but the sun loungers at the hotel pool are blocked every day by other vacationers with towels. In such a case, the Hanover District Court has now decided that the tour operator must intervene – or the travel price will be reduced accordingly.
In this specific case, a traveler filed a lawsuit against the organizer and demanded 986.70 euros back from the travel price – which, according to the court, he is entitled to. A court spokesman said it was a case-by-case decision.
According to the information, the plaintiff had booked a package holiday on the Greek island of Kos with the organizer in August 2024 for 7,186 euros. He contacted the tour guide and hotel staff in vain because the loungers at the pool were reserved with towels from 6 a.m., contrary to the prevailing ruleswithout guests having used them. The pool was important for his family and the children.

It was clear to the court that the trip had deficiencies because of the blocked loungers. And this means that the travel price can be reduced by 15 percent every day for the ten days claimed. This results in 986.70 euros. It should also be taken into account that the accommodation booked was in the upper price segment.

The organizer lodged an objection against a reminder notice for the amount, but paid 350 euros. The court decided that the plaintiff is also entitled to the remaining sum of 636.70 euros. The spokesman explained that it was consistent with the established case law of the Hanover District Court and other courts that in such cases there could be a lack of travel. (dpa)
