
A 42-year-old was sentenced by the Hanau regional court to a prison sentence of three years without parole for two cases of raping his wife and one count of grievous bodily harm in conjunction with threats.
Hanau/Sinntal – Judge Renata Kohlheim, chairwoman of the 7th Large Criminal Chamber, saw the Afghan's guilt as proven after several days of negotiations. The representative of the public prosecutor's office had demanded four years in prison for the crime, the defense attorney had only demanded a suspended sentence, the extent of which he left at the discretion of the court – and he had suggested a ban on contact with his ex-wife.
42-year-old rapes wife multiple times – three years in prison
According to the indictment, the crimes took place between January 2018 and May 2024. While the couple initially lived in Berlin with their children, two rapes by the defendant are said to have occurred in their shared apartment. After the family moved to Sinntal, the 42-year-old is said to have forced his 38-year-old wife to have sex two more times, in one case in a situation in which the injured party suffered painful injuries due to a previous fall on a bicycle.
The 42-year-old commented in detail on the allegations on the first day of the trial. He denied the alleged rapes through an interpreter and his lawyer.
According to his defense attorney, the defendant could not remember his wife rejecting him. The sexual contacts were always consensual. Especially since, in the defendant's opinion, “rape is no longer an issue” among Muslims after a German marriage has been completed.
The defense attorney only partially admitted the charges of grievous bodily harm and threats – but also with his own view of the accused. After a previous verbal argument, he threw his cell phone at his wife's head, injuring her, and later hit her several times in the head with his fist.
Neighbors and child weigh heavily on defendant in court
When she then fled to the balcony, he admitted that he had dragged her back into the apartment by her hair. However, he had a strange explanation for this: he was afraid that she would fall into the depths when she leaned on the supposedly defective railing. That's why he wanted to keep her safe. He considered gripping the hair to be more effective than gripping the hands.
Since the evidence situation was difficult in two cases of alleged rape, these were ultimately dropped by the chamber with a view to the other conviction. In the other incidents and also the assault, the court also had statements from neutral witnesses. Not only did the 38-year-old confirm the allegations, neighbors also described the events that contradicted the defendant's statements. Even one of the children gave information in court about the attacks that matched the woman's injuries.
The defendant first commented on the verdict with statements in his native language before calming down again. The punishment is not yet final. (ls)
